Your Family Will Need The Full Amount It’s Entitled To Receive
Illinois workers’ compensation provides death benefits to surviving dependent family members, including:
- Burial benefits of $8,000
- Survivors’ benefits for the spouse and dependent children
- When there is no primary beneficiary, totally dependent parents may receive benefits
Survivors’ benefits are calculated on two-thirds of the deceased’s gross average weekly wage during the year prior to the injury. This is subject to maximum and minimum limits:
- The minimum survivors’ benefit cannot be less than 50 percent of the statewide average weekly wage (SAWW) at the time of the injury.
- The maximum survivors’ benefit cannot be more than 133 1/3 percent of the SAWW at the time of the injury. The benefit is paid for 25 years of weekly benefits or $500,000, whichever is greater.
